GREEN CARD AND EAD APPROVED!
At the time of filing the I-485, Application to Register Permanent Residence, our client, an expert in the field of medical technology, was an H-1B visa holder.
This morning, USCIS delivered the approval notices to the firm's address.
In a few years, citizenship filing to follow.
The journey started with the filing of an EB-2(NIW) petition (priority date: November 1, 2023). The firm represented the client, too. Immigration cases take time, and early preparation can make a meaningful difference in planning your path to permanent residence.
Congratulations to this new Green Card holder! Thank you for trusting The Law Office of Akintunde F Adeyemo, PLLC to represent you. Under the current administration, the level of scrutiny has increased. Petitioners and applicants should prepare for RFEs and in-person interviews. Adjudicators are likely to look into the entire underlying petition (EB-2-NIW) during the I-485 stage. In this case, no RFE was issued for the I-485, but an RFE was issued for the I-140 petition. The adjudicator was satisfied with the brief, so there was no interview request.
EB-2 (NIW) is an employment-based second preference (EB-2) - National Interest Waiver (NIW) petition, and it is one of the statutorily approved ways for qualified foreigners to become permanent residents in the U.S., and, subsequently, become U.S. citizens. For EB-2 (NIW), your location is irrelevant (the ultimate question is: can you satisfy the requirements under Matter of Dhanasar, 26 I&N Dec. 884 (AAO 2016), inter alia?
The Law Office of Akintunde F Adeyemo, PLLC is now accepting new clients in the areas of EB-2 (NIW) and EB-1A.
