Triple Wins From Our Law Firm

Triple Wins From Our Law Firm: EB-2(NIW) Approved for a Client in the Field of Electronics & Communication Engineering; I-751, Petition to Remove Conditions on Residence, Approved for Another Client, and I-765, Application for Employment Authorization, Approved for Another Client

THE FIRST CASE: Our EB-2(NIW) client, a brilliant and highly sought-after aerospace engineer, currently holds the L-1B visa. This case, which the firm filed on October 18, 2025 (USCIS confirmed receipt on October 20, 2025), was expedited using the premium processing option (USCIS charges a separate fee to adjudicate a case within 45 days). The quick adjudication has no bearing on the outcome of the case, so think twice before making that expensive decision. Have this discussion with your attorney. The brief argued, inter alia, that his proposed endeavor — contributing to the advancements of electronics and communication engineering, with a specific focus on developing and implementing next-generation electrical power distribution systems for electric and hybrid-electric aircrafts, and the development and integration of safety-critical avionics and embedded systems for next-generation aerospace applications — will lead to projected future contributions by addressing issues that the United States has deemed to be of substantial merit and national importance: aviation safety, operational efficiency and sustainability.

With over fifteen years of specialized aerospace experience in the design, development and integration of safety critical embedded systems, our client has focused on advancing Electrical Power Systems (EPS), FIy-By-Wire Flight Control Systems (FCS), Next-Gen Flight Management Systems (FMS), Navigation and Cockpit Display Systems for next generation aircrafts. Our client's combination of technical mastery, regulatory knowledge, and proven program leadership uniquely qualifies him to contribute to the development of advanced, safety-critical aerospace systems that are vital to the U.S. aviation industry, economy, and national security, the brief argued. As a matter of fact, there was no RFE request, for the legal brief survived all the three prongs of the analytical framework in the precedent decision Matter of Dhanasar, 26 I&N Dec. 884 (AAO 2016).

THE SECOND CASE: Our client, a spouse of a U.S. citizen, sought the help of the firm after self-filing his Form I-751, the Petition to Remove Conditions on Residence. Though the initial self-filed case triggered an RFE, there was no invitation to appear before the adjudicating officer. After the RFE, the firm strategized with the client, particularly on how to address the specific issues raised in the RFE, and the case was approved on December 5, 2025. After a couple of years, our client can file for his citizenship.

THE THIRD CASE: Our client, who is waiting for his Green Card (I-485, Application to Register Permanent Residence or Adjust Status) to get approved, has now received an official confirmation that his I-765, Application for Employment Authorization, has been approved. This approval allows our client to start working in the United States. This particular case arose from an approved EB-2(NIW). On December 4, 2025, the case was approved.

Congratulations to all three clients!

Also, if your I-765, or I-485, application has been pending beyond the normal processing time, you can schedule an appointment with our attorney. With the latest priority date, based on the December Visa Bulletin, you should be proactive with your I-485/I-765 applications.
