Asylum Application Process



In the United States, an application for asylum is adjudicated under the specific procedural requirements of the Immigration and Nationality Act (INA).

 

While an asylum applicant must satisfy the definition of a refugee, unlike a refugee applicant, the asylum applicant must be physically present in the United States to apply for asylum. The asylum applicant must establish a credible fear of persecution or torture.

 

The burden of establishing past or a well-founded fear of persecution rests with the asylum applicant. The applicant must show that s/he has been persecuted in the country of origin or has a well-founded fear of persecution on account of race, religion, nationality, membership in a particular social group, or political opinion if returned to the country.

 

There are criteria for determining eligibility for asylum (i.e., the standard of a well-founded fear of persecution), as well as certain presumptions (for instance, persons who have been forced to abort a pregnancy or undergo involuntary sterilization; a person who has been subjected to coercive family-planning practices, pursuant to INA § 101(a)(42)).
